Intellectual Property Policy.

Last updated on July 15, 2020.

We respect the Intellectual Property Rights (IPR) of others and require our users to do so as well. This policy elaborates on how we deal with IPR infringement claims, what actions you can take of you see your copyrighted work being distributed without your permission and how Authors can respond to claims of IPR infringement being made against them.

What you can do if your IPR is infringed

Report: If you see your copyrighted item being sold by another Author on Vueghost Market without your permission, please use the “Report” button on the item page and mention “copyright infringement” as the reason for the report and include the URL link to your own copyrighted item.

Once you report the item, a notification will be sent to the Author of the item and Vueghost. The Author will have a chance to reply and clarify, in case there is a misunderstanding regarding the copyrighted item. The reply will be visible to you, the Author who reported the item and Vueghost. You may be able to sort out the issue directly between the two of you, without formal notice.

DMCA take down notice: if you are a copyright owner, you may consider using DMCA (Digital Millennium Copyright Act) process by sending us DMCA takedown notice.
DMCA takedown notice is a legal document - false claims can have significant legal consequences for you. Please consider if you need legal advice before submitting it. A DMCA takedown notice will be passed to the Author of the item mentioned in the notice. The Author may contact you directly to resolve the issue or he can submit a DMCA counter-notification if he disagrees with your DMCA takedown notice.

We will investigate and follow up with both Authors as we try to be fair with everyone and take appropriate action.

If your item is being distributed without your permission on another site, you may consider sending a DMCA takedown request to that website.

General IPR takedown request: If you own an IPR other than copyright (such as a trademark) and you see your content being used without your permission, you may consider sending us a General IPR takedown request.

Consequences: If we receive a valid copyright take-down notice or General IPR Notice, or if we believe that the content is in breach of anyone else’s rights, we will remove it. Authors repeatedly violating IPR will have their accounts terminated.

Although we make reasonable efforts to ensure safety, quality and legality of the items, we are not obliged to review content for IPR or other legal matters and we can not take responsibility for that. If items appear on Vueghost Market, it does not mean that we have checked and cleared copyright or other intellectual property rights. Each Author who uploads an item is responsible to ensure that his item does not infringe anyone’s IPR.

Vueghost does not provide legal advice. For legal advice, please contact a lawyer.

Vueghost cannot make legally binding judgments as we are not a court.
